COPYRIGHT INFRINGEMENT
Boreal Access respects the rights of copyright owners and will take such action as Boreal Access deems necessary or appropriate to ensure its service is used consistent with those rights. The Digital Millennium Copyright Act of 1998 provides copyright owners with a process for submitting claims of infringement to Internet Service Providers. Boreal Access will respond to such claims, and responses to such claims, in the manner described in this notice.
This notice does not constitute legal advice. Copyright owners and recipients of notices of infringement claims should seek legal advice regarding their rights and responsibilities
NOTICES OF CLAIMS OF INFRINGEMENT
If you believe any material available through Boreal Access infringes any right granted to you under United States copyright law, send notice to Boreal Access designated agent:

Your notice should comply with the provisions of the Digital Millennium Copyright Act of 1998, and should include the following:
1. The name, address, phone number, and email address of the owner of the copyright material which has been infringed upon, AND, a signed document of the person authorized to act on behalf of the copyright owner, and the name, address, phone number, and email address of that individual;Upon receipt of a notice that complies with the requirements of the Digital Millennium Copyright Act of 1998, Boreal Access will take down or block the material upon which a complaint has been filed, and notify the infringing party.
2. Identification of the material claimed to have been infringed;
3. Identification of the material causing the infringement: specific URL address, and the portion of the address containing the infringement;
4. A statement by the owner of the copyright material that it has good faith belief there is no legal basis for the use of the material; and,
5. A statement attesting to the accuracy of the notice, under penalty of perjury, that the complaining party is authorized to act on the behalf of the copyright owner.
COUNTER NOTICES
If a notice of infringement is given to you by the Boreal Access designated agent, you may file a counter notice, if you believe that the material at issue was misidentified or mistakenly alleged to be infringing. Your counter notice must comply with the requirements of the Digital Millennium Copyright Act of 1998 and should contain:
1. Your name, address, phone number, and email;Upon receipt of a counter notice, Boreal Access will notify the party that submitted the original notice of infringement, and within 14 days will restore the material in question, unless the matter has been referred to a court of law before that time.
2. Identification of the allededly infringing material and its location prior to its removal;
3. A statement, under penalty of perjury, that the material in question was removed by mistake or misidentification;
4. Your consent to the jurisdiction of the Federal District Court for the address you provide in your notice.
