There's enough evidence to charge a 12-year-old Solon Springs boy with attempted 1st degree intentional homicide, a Douglas County judge ruled during a preliminary court hearing Wednesday.

According to the criminal complaint, the 12-year-old stabbed his 7-year-old brother four times; once in the back, twice in the abdomen, and once near the heart.

The victim told police his brother did it and that he put a pillow over his face during the attack so no one could hear him scream. He also told police, "I was dead for a while."

The alleged attack happened on January 11 at a home in the Town of Solon Springs.

The 12-year-old is currently being held at the NW Regional Juvenile Detention Center in Eau Claire.

The victim is said to be doing OK.

In Wisconsin, juveniles over the age of 10 who commit the crime of attempted 1st degree intentional homicide are first sent to adult court.

A judge could decide to send it back to juvenile court.  A hearing on that decision is scheduled for March 5.
